History of the Institute of State and Law

Since the establishment of Institute of Legal Studies (31 st July 1967), the Institute of State and Law has experienced 50 years of building and development. The process is divided into three periods.

The period of 1959 - 1967:

 

The foundation of the Institute of State and Law today is the Legal Studies Group of the State Committee of Science. The State Committee of Science was established under the Ordinance No. 016-SL of 4th March 1959 of the President of the Democratic Republic of Vietnam. In the structure of the State Committee of Science at that time there was the Legal Studies Group. The Legal Studies Group was established in August 1959. Dr. Pham Van Bach, former Chairman of the Southern Vietnam Resistance and Administrative Committee, was appointed head of the Legal Studies Group. There are 5 sub-groups in the structure of the Legal Studies Group. Sub-groups of Theory and History of State and Law, and the Rule of Law headed by lawyer Tran Cong Tuong; sub-groups of Constitutional Law, Administration Law, Labour Law headed by lawyer Truong Tan Phat.

 

The research team of the Legal Studies Group was not many at the time, much of the work was concurred. The head of the Legal Studies Group, Pham Van Bach, at that time was the President of the Supreme People's Court, Vice Chairman of the Vietnam Lawyers' Association. However, based on these sub-groups, the Legal Studies Group still collects, attracts a large number of collaborators from other agencies to involve in the research. For example, participating in the study of theoretical law, Constitutional Law, Administrative Law were prestigious researchers at that time, such as: Mr. Phan Anh, Pham Giang, Vu Boi Tan, Vu Dinh Hoe, Ta Nhu Khue, Dam Van Hieu.

 

It can be said that the Legal Studies Group is one of the first centers in Vietnam to gather legal staff to study state and law. The work of the Legal Studies Group has laid the foundations for the establishment of the leading scientific research base of law experts.

 

The period of 1967 - 1986:

 

In 1967, the Government Council issued Decree No. 117 / ND-CP dated 31st July 1967 providing tasks, competence and organizational structure of the Vietnam Commission of Social Sciences. In the organizational structure of the Vietnam Commission of Social Sciences, there was the Institute of Legal Studies, the precursor of Institute of State and Law today. The Institute of Legal Studies was established on the basis of the Legal Studies Group. The head of the Legal Studies Group, Pham Van Bach, was also assigned to be the Director. He was the first director of the Institute of Legal Studies and held that position between 1967 and 1970.

 

From 1970 to 1986, the Institute was headed by Professor Nguyen Ngoc Minh. In 1980, Assoc. Prof. Dr. Nguyen Nien was appointed as the first Deputy Director of Institute of Legal Studies.

 

Recognizing the importance of education law degree, in 1976, the State decided to establish the Juridical Faculty (now the Faculty of Law) at Hanoi Assumption University. The Juridical Faculty was the first and only institution to provide legal education at the undergraduate level in the country at that time. The leaders of the Institute of Legal Studies have been assigned the responsibility of leading the Juridical Faculty. Prof. Nguyen Ngoc Minh was appointed as the first Dean of the Juridical Faculty. Assoc. Prof. Nguyen Nien is the Assistant Dean of the Faculty. Some other researchers of the Institute are also involved in teaching here. When the Hanoi Juridical University (now Hanoi Law University) was established, Prof. Nguyen Ngoc Minh was appointed as the first president of the University (1979 -1982) and Assoc. Prof. Nguyen Nien is the first vice president of the University. The involvement of staff of the Institute, especially the Institute's leaders in the activities of other institutions, showed cleaerly the role of the Institute in general, the role and prestige of staff of the Institute in particular.

 

In 1972, the mouthpiece of the Institute of Legal Studies and the law experts in Vietnam, the Journal of Law was established and became part of the organizational structure of the Institute of Legal Studies.

 

The period of 1986 to present:

 

In 1986, Institute of Legal Studies was renamed Institute of State and Law in accordance with Decree No. 64 / HDBT dated 23rd May 1986 of the Council of Ministers. Accordingly, Institute of State and Law has the task of studying theory on state and law from the point of Marxism-Leninism, applying to specific conditions of Vietnam; gradually building the Vietnamese legal theory, actively contributing to strengthening the socialist legality in Vietnam.

 

In 1986, Prof. Nguyen Ngoc Minh relinquished the position of Director. Assoc. Prof. Nguyen Nien was assigned the Deputy Director in charge of the Institute until November 19, 1988 (according to Decision No. 366 QD / TCCB dated 19th November 1988 of the Chairman of the Vietnam Committee for Social Sciences). In November 1988, the new leader board of the Institute was appointed, including Prof. D.Sc. Dao Tri Uc as Director, Assoc. Prof. Dr. Tran Trong Huu and Assoc. Prof. Dr. Hoang The Lien as Vice Directors.

 

In 1987, the Journal of Law was renamed to State and Law Review.

 

In 1993, together with the establishment of the National Center for Social Sciences and Humanities under the Government's Decree No. 23 / CP of 22nd May 1993, Institute of State and Law was renamed to Institute of State and Law Studies of the National Center for Social Sciences and Humanities. The leader board of the Institute from 1997 to 2003 was composed of Prof. D.Sc. Dao Tri Uc as Director, Assoc. Prof. Dr. Le Minh Thong and Assoc. Prof. PhD. Vo Khanh Vinh as Vice Directors.

 

In 2004, the Government issued Decree No. 26/2004 / ND-CP dated 15th January 2004 renaming the National Center for Social Sciences and Humanities to Vietnam Academy of Social Sciences. Institute of State and Law Studies continued to be part of the organizational structure of the Vietnam Academy of Social Sciences, but was renamed to Institute of State and Law as its name in the period 1986-1993. Institute of State and Law organized and operated under the Decision No. 989 / QD-KHXH dated 14th June 2005 of the President of Vietnam Academy of Social Sciences defining functions, tasks, authorities and organizational structure of the Institute of State and Law. The leader board of the Institute for the period from 2006 to 2008 includes Prof. D.Sc. Dao Tri Uc as Director, Assoc. Prof. Dr. Nguyen Nhu Phat (since 2006) and Dr. Nguyen Thi Viet Huong (since 2007) as Deputy Directors. Beside working at the Institute, Prof. D.Sc. Dao Tri Uc also served as Vice President and General Secretary of the Vietnam Lawyers Association (from 2004 to 2009).

 

At the end of 2008, Prof. D.Sc. Dao Tri Uc transferred to the Vietnam Lawyers Association and then to Faculty of Law, Vietnam National University. The new leader board of the Institute includes Assoc. Prof. Dr. Nguyen Nhu Phat (Director from 2008 to 2015), Assoc. Prof. Dr. Nguyen Thi Viet Huong (Vice Director until 2013) and Assoc. Prof. Dr. Bui Nguyen Khanh (from 2013 to 2015). Along with the work at the Institute, Director Nguyen Nhu Phat also holds the position of Deputy Dean of Faculty of Law, Graduate Academy of Social Sciences. A number of managers of the Institute also hold the positions of Vice Dean, Head of the Deparment at Faculty of Law, Graduate Academy of Social Sciences such as Assoc. Prof. PDrhD. Pham Huu Nghi, Assoc. Prof. Dr. Nguyen Thi Viet Huong, Assoc. Prof. Dr. Vu Thu, Dr. Le Mai Thanh.

 

From 2015 up to now, the Board of Directors of the Institute consists of the Director, Assoc. Prof. Dr. Nguyen Duc Minh, and Vice Director Dr. Pham Thi Thuy Nga. Director Nguyen Duc Minh is concurrently Deputy Dean of Faculty of Law, Graduate Academy of Social Sciences (from February 2017).

 

The name of the Institute of State and Law has remained unchanged since then, although the Vietnam Academy of Social Sciences has modified its functions, duties and powers. and organizational structure in 2008, 2012, 2013 and 2017.

 

Currently, according to Decision No. 2056 / QD-KHXH dated 30th November 2017 of the President of the Vietnam Academy of Social Sciences, the organizational structure of the Institute consists of 08 research departments, 04 professional and specialized departments and the State and Law Reivew. The list is as follows:
